These Terms of Use apply to peggrid.com.au and the online services operated by WILD IN AU PTY LTD (ABN 53 686 277 850), trading as PegGrid (PegGrid, we, us). Separate product, quote, order, delivery, return and warranty terms may also apply.
Australian Consumer Law
Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including under Australian Consumer Law. If another part of these terms is inconsistent with a non-excludable right, that right prevails.
Using the website
You may use the website for lawful personal or business purchasing and enquiry purposes. You must not interfere with the site or its security, introduce malicious code, scrape or harvest data in a way that breaches law or our rights, impersonate another person, submit unlawful content, or use the site to infringe another person’s rights.
We may restrict access where reasonably necessary to protect the site, customers or PegGrid, investigate misuse or comply with law.
Product information
We aim to keep descriptions, dimensions, compatibility, images, prices and availability accurate. Images and colours can vary by screen and production batch. Planning dimensions should be checked against the current product page and instructions before purchase or installation.
If we identify a material error before accepting or fulfilling an order, we will contact you with the available options. We will not rely on this clause to avoid an order or remedy where doing so would be unlawful.
Orders and payment
An order is an offer to buy. PegGrid accepts it when we confirm acceptance or begin fulfilment, unless the checkout or order confirmation states otherwise. We may decline or cancel an order for a genuine reason such as unavailable stock, a pricing or description error, suspected fraud, an unsupported delivery address or breach of these terms. If payment has been taken for a cancelled order, it will be refunded.
Prices for Australian customers are in Australian dollars and include GST unless clearly stated otherwise. Delivery and other order-specific charges are shown before checkout is completed.
Pre-orders
A pre-order page will state the expected availability or dispatch estimate. Estimates may change. PegGrid will provide updates about a material delay and the options available under the order terms and applicable law.
Delivery, returns and warranty
See Shipping & Delivery, Returns & Refunds and the Limited Lifetime Structural Warranty. These documents form part of the terms applying to the relevant order, subject always to rights that cannot be excluded.
Assembly, compatibility and safe use
You must follow the current assembly, compatibility, care and load instructions, use the product on a suitable level surface and stop using a component that appears unstable or damaged. Never climb on PegGrid or use it as a ladder. These responsibilities do not remove any liability PegGrid has for a defective product or inadequate instruction under applicable law.
Trade and project enquiries
A discussion, recommendation or preliminary estimate is not an accepted order. Project price, configuration, scope, lead time, freight, installation and any custom work are binding only when stated in an accepted written quote or order confirmation. Standard trade approval does not grant resale, distribution, agency, territory, exclusivity or intellectual-property rights.
Intellectual property
PegGrid or its licensors own the website content, branding, designs, photographs, graphics, video and other materials, except where stated otherwise. You may view and use them for ordinary shopping and personal reference. You may not reproduce, modify, publish, sell, license or commercially exploit them without permission or another lawful basis.
Reviews, images and other submitted content
You must have the necessary rights and permissions for content you submit. Unless separately agreed, submitting content for publication grants PegGrid a non-exclusive, worldwide, royalty-free licence to host, reproduce, crop, format and display it for operating and promoting PegGrid, with creator attribution where reasonably practicable. This does not transfer ownership to PegGrid. PegGrid may remove content that is unlawful, misleading, infringing or inappropriate.
Third-party services and links
The store uses Shopify and other providers and may link to third-party services. Their separate terms and privacy policies may apply. PegGrid is not responsible for third-party content it does not control, but remains responsible for its own obligations and for rights that cannot be excluded.
Liability
To the extent permitted by law, PegGrid is not liable for loss caused by your unlawful use of the website, failure to follow product instructions, incompatible modifications or events outside PegGrid’s reasonable control. PegGrid does not exclude liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct or applicable consumer guarantees.
Changes
We may update these terms for future website use and orders. The current version and last-updated date will appear here. Changes do not retrospectively remove accrued rights or alter an accepted order unless agreed or permitted by law.
Governing law
These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales and courts entitled to hear appeals from them have non-exclusive jurisdiction, subject to any rights you have to bring a claim elsewhere under applicable law.
